3053. The provisional nature of the registration of a right that was uncertain is cancelled upon the presentation of an application in which the owner recognizes the existence of the right evidenced by the registration.
However, where an advance registration of a judicial demand was made in respect of the uncertain right, the provisional nature of the registration of the right, and the advance registration of the judicial demand in respect of that right, are cancelled upon the presentation by the owner of an application to which is attached a certificate from the clerk attesting that the action has been discontinued or a judgment having acquired the authority of a final judgment (res judicata) which confirms the existence of the right evidenced by the registration.
